News: Barmen cleared of manslaughter charges

Two Irish barmen have been acquitted of manslaughter following the death of a customer from acute alcohol intoxication.

Duty of care

The Judge, Judge Thomas Teehan, ruled that although there was a duty of care owed by the barmen, and that that duty had been breached, there should be a high importance placed on individual responsibility.

Individual responsibility

The customer’s decision to consume the drink (a cocktail of eight shots in a single glass) constituted a supervening event to break the chain of causation and so whilst the two barmen were guilty of gross negligence this negligence was not the cause of death.
